These terms cover your use of bloomnetwork.ai, run by Bloom Inc. (“Bloom”, “we”). By using the site, you agree to them. If you have a Bloom account, the network terms you accepted when you joined, and any agreement you signed with us, govern your use of the platform and take priority over these terms where they differ.
1. What Bloom is
Bloom is a network that connects hardware companies (“brands”) with U.S. providers of design, engineering, manufacturing, testing, warehousing, freight and service. A brand posts a request, Bloom matches it to providers whose capabilities fit, interested providers express interest, and the brand approves who bids and compares the bids. Providers do the work.
We don’t guarantee that a request will be matched, that a provider will bid or have capacity, or any price, timeline or outcome. Extended payment terms are subject to credit approval and to the terms that apply to them. Nothing on the site is an offer to provide a specific service at a specific price.
2. Information on the site
Guides, regulatory and freight information, funder directories, network figures, service suggestions (including ones made by an AI model) and similar content are for general information only. They aren’t legal, regulatory, financial, tax or engineering advice, may be incomplete or out of date, and shouldn’t be relied on without checking with a qualified professional. Network figures are approximate.
3. What you send us
When you send us a message, a request or an application, you confirm the information is accurate and that you’re allowed to share it, and you let us use it to respond, to match your request with providers, and to run our service, as described in our Privacy Policy. Don’t send export-controlled technical data, classified information or anything you aren’t permitted to share through a public website form; tell us first and we’ll arrange the right channel.
4. Acceptable use
You agree not to:
- scrape, crawl or copy the site or its directories in bulk, or access our APIs except as we permit;
- interfere with the site’s security or operation, or try to get around access controls;
- use the site to send spam, misrepresent who you are, or contact listed people or companies for purposes unrelated to their listing;
- use the site in a way that breaks the law or anyone’s rights.
5. Intellectual property
The site, its text, design, graphics, software and the Bloom name and logo belong to Bloom or its licensors. Customer and member names, logos and photos belong to their owners and appear with their permission. You may view and share pages for your own business use; any other use needs our written permission.
6. Other sites and services
The site links to and embeds third-party services, such as Google Calendar for booking calls and the Bloom platform at app.bloomnetwork.ai. Their own terms and privacy policies apply, and we aren’t responsible for third-party sites.
7. Disclaimers
The site is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we don’t warrant that the site will be uninterrupted or error-free.
8. Limitation of liability
To the fullest extent the law allows, Bloom won’t be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the site. Our total liability for any claim about the site is limited to one hundred U.S. dollars. Some places don’t allow these limits, so they may not all apply to you.
9. Indemnity
You agree to defend and indemnify Bloom against claims arising from your misuse of the site or your breach of these terms.
10. Governing law and disputes
These terms are governed by the laws of the State of Michigan, without regard to its conflict-of-law rules. Any dispute about the site will be brought in the state or federal courts in Wayne County, Michigan, and you and Bloom consent to their jurisdiction. Before filing a claim, please contact us so we can try to resolve it informally.
11. Changes
We may update these terms. The date at the top shows the current version, and using the site after a change means you accept the updated terms.
